1. Agreement to Terms

By downloading, installing, or using our mobile applications or digital products (the "Services") from the Apple App Store, Google Play Store, or our digital platforms, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access or use the Services.

2. Use License & Intellectual Property

The software and digital products provided through the Services are licensed, not sold, to you. Permission is granted to download and install one copy of the digital product or App per device for personal, non-commercial transitory use only.

This is the grant of a limited, non-exclusive, non-transferable license, and under this license, you may not:

Modify, copy, or create derivative works of the software;
Use the materials for any commercial purpose or public display;
Attempt to decompile, reverse engineer, or extract the source code of any software;
Remove any copyright or other proprietary notations;
Transfer the materials to another person or "mirror" the materials on any other server.

3. In-App Purchases and Subscriptions

Payment Processing: All transactions are processed through the Apple App Store or Google Play Store. You agree to comply with their respective terms of service.
Subscriptions: Some Services are billed on a recurring basis (monthly or annually).
Automatic Renewal: Your subscription will automatically renew unless cancelled through your App Store or Google Play account settings at least 24 hours before the end of the current billing period.
Refunds: Because our products are digital and delivered immediately, all sales are final. Refund requests are handled exclusively by the App Store or Google Play Store according to their respective policies.

4. User Conduct

You agree not to use the Services for any purpose that is unlawful or prohibited by these Terms. You may not use the Services in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use and enjoyment of the Services.

5. Third-Party Store Terms

You acknowledge that these Terms are between you and Puggle Studio only, and not with Apple or Google.

Maintenance: Puggle Studio is solely responsible for providing maintenance and support for the Apps. The App Stores have no obligation to furnish such services.
Third-Party Beneficiary: You acknowledge that Apple and Google are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

6. Disclaimer

The materials and Apps provided by Puggle Studio are provided on an 'as is' basis. Puggle Studio makes no warranties, expressed or implied, and hereby disclaims all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

7. Limitations of Liability

In no event shall Puggle Studio or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the digital products or Apps, even if Puggle Studio has been notified of the possibility of such damage.

8. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will cease immediately.

9. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Victoria, Australia, and you irrevocably submit to the exclusive jurisdiction of the courts in that State.
